These are our rules if you want to use our website and the services or products available from it. If you do not agree to these rules, you cannot use our Site. We can change these rules whenever we want and will post the new rules on our Site, whether you notice them or not. We have intentionally written them in a way that avoids legalese so that everyone can clearly understand and agree to the rules and understand their rights and responsibilities.

We hope there won’t be any problems and that you will reach out to us if you are having issues with our Site, service, or products.

1.0 Site Services

We agree to provide you with services, or the “Service(s),” on our Site and any sub-domains or related social media channels. In exchange for providing these services, we require you to follow these rules:

1. You must be at least 13 years old to use the Site, or if you are a resident of the EU, you must be at least 16 years old. Do not lie about your age. If you are under 18, a parent or legal guardian must agree to these rules on your behalf. If you are not sure a parent or guardian agrees to these terms, please stop using the Site.
   
2. Do not use the Site to do anything illegal or break the rules in our terms of use.
   
3. Do not change anything about our website or applications, upload any type of virus or malware, or do anything that might interfere with the way the Site or its services work.
   
4. Do not do anything that might affect how other people use and enjoy the Site. Be a good neighbor.
   
5. Do not encourage anyone to break these rules.
   
6. Use your common sense and be a good human.
   
7. Do not post anything violent, or anything that promotes violence or violent groups, or anything that might make other people feel scared.
   
8. Do not post content that contains nudity, sexual violence, or commercial sexual services.
   
9. Do not post content that promotes crime or anything that would break US law.
   
10. Do not post content related to certain regulated goods, such as selling or trading non-medical drugs, pharmaceutical drugs, or marijuana.
    
11. Do not bully anyone or post anything horrible about people. Bullying includes making degrading statements or posting inappropriate images that threaten someone. If you wouldn’t say it to someone’s face, don’t say it on the Site. If you can’t say anything nice or constructive, consider not saying anything at all.
    
12. Do not scrape, post, or share personal or private information about someone else on this Site or from information gained from this Site. This includes someone’s contact information such as their phone number, address, email, location, or other private details. Posting private information or “doxing” can be a criminal offense in some states.
    
13. Do not post material that doesn’t belong to you or that infringes on someone else’s intellectual property.
    
14. If we allow you to set up accounts, do not use anyone else’s account without their permission or try to access their login details. Keep your own credentials private. Do not create an account with someone else’s name, including a famous person or company. If you lie when you set up an account, you can be permanently removed.
    
15. Do not use any type of software or automated tool to create accounts or access the Site, and do not use such tools to send spam or unwanted messages.
    
16. Do not register an account if your previous account was disabled or if you were removed for violating our rules.
    
17. Do not register for an account if you are prohibited from doing so under any applicable laws in your jurisdiction.
    
18. We may require you to change your account credentials or username/password for any reason.
    

2.0 Your Rights

2.1 You have the right to feel safe using the Site.

2.2 You have the right to your privacy on the Site. Please refer to our homeschoollanguages.com/privacy policy for details.

2.3 Any communications made through our contact page, blog, blog comments, newsletter sign-up, or other pages, or directly to us through phone, mail, or email are not confidential and are subject to viewing and distribution by third parties. We own any communications displayed on our website, servers, comments, emails, or other media as allowed by United States law. We do not provide credit or pay royalties for unsolicited user-generated content such as blog comments or emails.

We reserve the right (but not the obligation) to republish or distribute anything you upload to our Site for any purpose. You agree not to submit any content that is illegal or serves an unlawful purpose, including potentially libelous, maliciously false, obscene, abusive, negligent, harmful, or inappropriate content. You agree not to submit any information that is confidential, privileged, or that should not be shared publicly.

2.4 If we offer user accounts and you are a resident of the EU, you have the right to be forgotten and may delete your account and content at any time by logging in and submitting a delete request. It may take a few days to process, and some content may remain visible in the meantime. Content shared elsewhere may not be deletable. We may also keep registration information as needed to operate our business and comply with these rules.

2.5 You are responsible for anything you do under your login, including what you post or comment. You are responsible for ensuring the material you post belongs to you, including music or photos. If you post something you shouldn’t and receive a fine, you are responsible for paying it.

3.0 Our Rights

3.1 We are not responsible for the following:

Links to other websites or companies, even when the link appears on the Site.

What happens when you connect your Site account to another website or service. You should read the rules for that service, including third-party logins and their privacy policies.

Your mobile data charges for using the Site or its services.

Any content copied or stolen from the Site by someone else. Posting user-generated content is at your own risk. We may display, share, reproduce, transform, edit, and use any UGC worldwide in perpetuity.

3.2 We may end the Site or its services at any time or stop you from using the Site for any reason without notice. We may delete content you have uploaded for any reason, even if you disagree. We do not have to compensate you for deleted content, even if it generated income.

4.0 Intellectual Property Rights

4.1 All images, text, designs, graphics, trademarks, and service marks are owned by the Company or the properly attributed party. It is a violation of United States federal law to use any of our intellectual property in whole or in part. Any distribution or modification of materials from this Site or related services, products, or offers is illegal and may result in damages or injunctions.

You may not use our intellectual property without permission, including copying text, screenshotting or reposting images or designs, or sharing any content on another site or social media. Not all sharing is caring. We invested significant time and money into creating our IP. Respect intellectual property rights.

By posting or submitting any material (including comments, blog entries, social media posts, photos, videos, or any content submitted via email, text, voicemail, or software such as Zoom recordings), you represent that you either own the material or have permission from the owner, that you are at least eighteen years old, and that you grant us a royalty-free, perpetual, irrevocable, worldwide license to use, copy, modify, sell, distribute, create derivative works, or publicly display the material for any purpose. You also grant us the right to identify you as the author by name, company, email, or screen name.

4.2 DMCA Policy:

We may suspend, disable, or terminate users who repeatedly infringe the copyrights, trademarks, or other intellectual property rights of others. The Digital Millennium Copyright Act (“DMCA”) provides recourse for copyright owners who believe online material infringes their rights. The text of the DMCA is available at the U.S. Copyright Office website.

If you believe in good faith that materials on the Site infringe your copyright, you may send a notice requesting removal. The notice must include:

The physical or electronic signature of the copyright owner or authorized agent.

Identification of the copyrighted work claimed to have been infringed.

Identification of the infringing material and information sufficient to locate it.

Your name, address, phone number, and email.

A statement of good faith belief that the use is not authorized.

A statement that the information is accurate and that you are authorized to act on behalf of the owner, under penalty of perjury.

5.0 This Agreement

5.1 If you use third-party services on the Site, including payment processors, you must follow their rules. If those rules conflict with these rules, theirs apply.

5.2 If any part of this Agreement is found unenforceable, the rest remains valid.

5.3 Changes to this Agreement must be made in writing. If we fail to enforce any rule, we still retain the right to enforce it later.

5.4 We reserve all rights not expressly granted in this Agreement.

5.5 No third parties have rights under this Agreement.

5.6 You cannot transfer your rights or obligations without our consent. We may transfer ours, including in the event of a sale or legal requirement.

6.0 Advertising, Affiliates, and Testimonials

This Site may use advertising or affiliate links. We disclaim liability for your purchases made through these links. We will make reasonable efforts to notify you of ads or affiliate links in addition to this disclaimer. You accept liability for any consequences of clicking affiliate links. Testimonials reflect true experiences, but results may vary.

7.0 Refunds, Access, and Payment Collection

7.1 Refunds:

We take our business seriously. Please consider your purchases carefully.

No refunds are provided for products unless otherwise stated in writing.

The Company may charge 1.5 percent interest per day on unpaid balances after 15 days from the due date.

After 30 days of non-payment, the Company may send your account to collections, and you will owe the outstanding amount plus collection costs and attorney fees.

7.2 We may discontinue or modify any part of this website without notice. If we discontinue an online product or service you paid for and no duration was specified, it will remain available for at least 90 days or as long as we support that version, whichever is longer. “Lifetime access” refers to the lifetime of the product, not your lifetime.

8.0 Shipping

We offer shipping for products purchased through our Site.

We will make reasonable efforts to ship within 10 business days, but times may vary by product availability and destination.

Shipping costs are calculated at checkout based on method and destination.

We are not responsible for delays, damages, or losses during shipping. Risk transfers to you when shipped.

International orders may incur customs fees, taxes, or duties, which are the buyer’s responsibility.

9.0 Limits on Liability

9.1 The Site operates “as is,” and we cannot guarantee it will always be safe or error-free. We disclaim all warranties to the fullest extent allowed by law.

9.2 Company and its agents are not liable for any damages, including direct, indirect, punitive, incidental, special, or consequential damages, regardless of the type of claim. Some jurisdictions do not allow certain limitations, so liability may be limited to the extent permitted.

Translation: If something bad happens when you use this website, we are not responsible, and you cannot make us pay. Even if we knew something could happen, we still don’t have to pay, except where required by law.

9.3 Our maximum liability is limited to the actual amount you paid for the product that caused the issue. This limitation is part of the basis for our pricing.

9.4 We do not control what others say or do and are not responsible for their conduct or content, even on our Site. We are also not responsible for services or features offered by others.

9.5 We cannot predict when issues may arise. Our liability is limited to the fullest extent allowed. We are not responsible for lost profits or data. The total liability is the greater of $100 or the amount you paid us in the last twelve months.

9.6 You agree to defend and indemnify us from claims arising from your violation of these Terms. You must cooperate with us, and you may not settle claims without our consent.

Translation: If you break the rules and it causes problems, you must help fix them and pay associated costs. We handle the legal side.

9.7 Nothing on this Site is intended to diagnose or treat illnesses or to act as legal, medical, tax, or financial advice. Information is for educational purposes only. Do your research.

10.0 How We Handle Disputes

10.1 If you have a legal issue with the Site, you agree to binding arbitration under the AAA. You waive your right to court or class action. Small claims, intellectual property disputes, and unauthorized service interference claims are exceptions.

10.2 If you fail to make required payments, the Company may immediately begin collections without arbitration.

10.3 Non-arbitrated claims will be handled exclusively in Wyoming courts. You consent to their jurisdiction.

10.4 Wyoming law governs these Terms unless preempted by federal law.

10.5 We appreciate feedback but may use it without compensation or confidentiality.
